I. Company Details

Sumatra EcoTravel Bukit Lawang is a travel operator in Bukit Lawang, Sumatra/ Indonesia, specialized in operating sustainable and responsible travel services in Sumatra, Indonesia. Travellers can book package tours and individual travel services, such as tours, pickup-services, hotels supported through our disclosed agent Sumatra EcoTravel in Germany. Our team in Bukit Lawang will operate the travel services or organise further services provided by third parties.

II. Contracting

1. With help of the travel broker Sumatra EcoTravel the client can combine different individual travel services. Sumatra EcoTravel will act as disclosed agent and will carry out all necessary communication and making advance reservations for the trip.

2. The client will then receive a reservation confirmation by e-mail, rendered by Sumatra EcoTravel Bukit Lawang, including all tour and travel details, prices and fees. If the client declares acceptance of the offer by paying a deposit to secure the booking, then the contract with the tour operator is concluded. Once the deposit has been received, the client will receive a booking confirmation via email from the tour operator. For organizational reasons, reservations cannot be accepted later than 3 days before arrival.

3. If the reservation confirmation differs from the requested offer, the client may request a new offer. If the client accepts the new offer by email and by paying the deposit, the scope of contractual services is regulated by the specifications in the reservation confirmation.

Please note: Our disclosed agent, Sumatra EcoTravel, does not assume any responsibility for the travel products and services provided by the tour operator and makes no representations or warranties (express or implied) about the suitability or quality of travel products and services featured on the website www.sumatra-ecotravel.com. Sumatra EcoTravel is not a party to the contractual relationship. Any queries or concerns relating to the product should be addressed to the tour operator.

III. Payment / Documents

1. After contracting a deposit of 20 – 100% of the tour price, as stated in the confirmation, is payable. The deposit shall be made in Euro or IDR.

Credit card payment is possible through our website (PayPal service). You can use Visa, Mastercard and several other cards. Just click the “Pay now” button on the right hand bottom of our homepage and follow the instructions through our safe payment service!

The final payment (i.e. full price minus deposit) is due upon arrival in Bukit Lawang in Indonesian Rupia and payable to the operator. If payment in Indonesian Rupia is not possible, payment can be made by credit card as an exception. Please note that in case of payment by credit card an additional fee of 3% of the tour price will be charged.

2. If the client doesn’t pay the deposit in time, the operator is entitled to terminate the contract without notice or to refuse carrying out the travel services.

3. If any documents are required, the client will receive these after the full price is payed.

IV. Cancellation / Changes

1. Cancellation by client

Cancellations can be made at any time prior to arrival or in case of hotel bookings prior to check-in. Cancellations have to be declared by e-mail to info@bukitlawang-ecotravel.com. Phone calls will not be accepted.

The following partial refunds of the tour price will be made according to the time when the cancellation is declared:

46 – 65 days 60%
11 – 45 days 50%
10 days or less 10%

As defined by the day of receipt of the cancellation e-mail.

No refunds will be made, if the client doesn’t participate without cancellation, unless this is caused by a violation of contractual duties of the operator.

2. Changes by client

Changes to the tour date/ time/ route, if possible at all, can take place up to three weeks prior to arrival without a fee being charged.

A change of the traveller’s name (i.e. another person travelling) can only take place if the participation is not bound to the approval of local authorities.

Sumatra EcoTravel Bukit Lawang strongly recommends personal and travel insurance to cover accidents, injury, loss of personal property or cancellation. Contracts with the tour operator in Bukit Lawang do not include travel insurance or trip cancellation insurance.

3. Changes or Cancellations by Sumatra EcoTravel Bukit Lawang

Sumatra EcoTravel Bukit Lawang is entitled to cancellations in case of violation of liabilities to pay by the client. In this case refunds will be made according to clause IV1.

If, for any reason outside the control of Sumatra EcoTravel Bukit Lawang tours tour packages or travel services cannot be operated, especially in case of unforeseen circumstances such as natural disasters, political situations, epidemics and others, the operator is entitled to carry out changes in services. If changes are not possible or unreasonable, Sumatra Eco Travel or the client are entitled to cancellation.

Unfortunately clients cannot expect a refund of the deposit, even in the event of a disaster such as war, pandemics, or other similar circumstances. Being a small family business, a refund of the deposit is difficult for the tour operator as Sumatra EcoTravel Bukit Lawang is still sustaining a lot of locals by employing them and by using their services as suppliers. In these exceptional cases, however, the amount may be used for new bookings up to two years later.

V. Restrictions to Liability

1. All clients participating in a tour operated by Sumatra EcoTravel Bukit Lawang do so at their own risk. To the maximum extent permitted by law the liability is limited to an amount of 100% of the tour price. This restriction of liability applies to damages caused through intention or culpable negligence by the tour operator.

2. Tours arranged by Sumatra EcoTravel Bukit Lawang involve certain risks and dangers. These include: traveling in mountain terrain, trekking in dense rainforest and crossing rivers; unpredictable behavior of wildlife; accidents caused by the forces of nature; accidents or illness in remote regions with little or no medical facilities and without any means of rapid or free evacuation; accidents caused by Indonesian traffic. As Sumatra EcoTravel Bukit Lawang’s tours do not include insurance, the tour operator accepts no liability for the matters mentioned above or for any resulting illness or death. Travel Insurance lies within the responsibility of each client. The tour operator recommends personal and travel insurance to cover accidents, injury or loss of personal property.

3. The tour operator is not liable for any damages or injuries suffered in consequence of anything, howsoever caused, in connection with services carried out by third parties or arising from the use of accommodation or transportation or other service, or for labour strike, political unrest, weather conditions or natural disasters which are beyond their control.

4. Please be aware that by booking travel services the client confirms that his state of health complies with the travel requirements and that the client doesn’t suffer from any cardiac diseases and/or circulatory disorders. The tours operated can be very strenuous and therefore cause danger to persons suffering from cardiac or circulatory disorders. Therefore a health check with your doctor is an absolute necessity before travelling to the Sumatran jungle and lies within the responsibility of each client!

5. The tour operator must be informed by the clients in advance of any health conditions, such as high blood pressure, allergies, previous operations or pregnancy, as well as any fears of certain insects, heights or the dark! Please note: for safety reasons, Sumatra EcoTravel Bukit Lawang may prohibit certain clients from taking part in a jungle trek.

VI. Clients’ Duties

1. By booking travel services the client confirms that his state of health complies with the travel requirements and that the client doesn’t suffer from any disorders. The tours operated can be very strenuous and therefore cause danger to persons suffering from cardiac or circulatory disorders. A health check with your doctor is an absolute necessity before travelling to the Sumatran jungle and lies within the responsibility of each client.

2. As Sumatra EcoTravel Bukit Lawang’s tours do not include insurance, the tour operator accepts no liability for sudden illness, accidents or death. A comprehensive travel Insurance lies within the responsibility of each client. By booking the trip, the client confirms that they have understood this and agree to it.

3. If the client wishes to file a claim or an action regarding insufficient services, he must complain immediately in our office in Bukit Lawang, otherwise any rights shall be extinguished, except the client is not responsible for the delay of complaint.

VII. Time limitations on claims and actions

1. All services must be carried out/ operated from Bukit Lawang in Northern Sumatra and Aceh region.

2. Any right to insufficient services shall be extinguished if a complaint is not filed within 7 days of the date the service has ended.

3. Any right to damages or insufficient services shall be extinguished if an action is not brought within one month of the date the service has ended.

VIII. Travel Documentation

It is each client’s personal responsibility to ensure that he or she has valid travel documentation which meets the requirements of immigration and other authorities in Indonesia.

The client is responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of Indonesia. Prior to travel the client must present all entry, exit, health and other documents required by law. The client will be responsible to pay any fine or charge assessed by the Government concerned. The client is responsible for obtaining all necessary information on regulations, laws and travel requirements.

Any fines, penalties, payments or expenditures incurred as a result of breach of these requirements shall be paid by or charged to the client.

IX. Agreement

By paying the deposit required in the respective reservation confirmation to secure the booking with Sumatra EcoTravel Bukit Lawang, clients agree to these terms and conditions, as explained above.

X.

If any of these terms and conditions do not correspond  with laws and regulations of Indonesia or International Treaties it shall be replaced by the corresponding regulation of the law concerned.

Sumatra EcoTravel acts as disclosed agent for the tour operator Sumatra EcoTravel Bukit Lawang (PT. Sumatra EcoWisata Bukit Lawang). When you make a booking via Sumatra EcoTravel the contract will be with the tour operator Sumatra EcoTravel Bukit Lawang, Jln Besar Orangutan, Bukit Lawang, Bohorok, KAB Langkat, North Sumatra, Indonesia (Postcode 20774). Sumatra EcoTravel is not a party to the contractual relationship. Any queries or concerns relating to the product should be addressed to the tour operator. The contract details, terms and conditions, for the tour operator can be seen in the confirmation e-mail or on our website.

III. Tour Operator Conditions

The following applies to all products or services booked via our website:

The tour operator’s terms and conditions and the specifications in the tour confirmation will apply in addition to those set out here. The tour operator’s terms and conditions may include provisions relating to payment procedures, default, liability, cancellations, changes of bookings and refunds (if available) and any other restrictions.

1. Contracting

You can choose out of and combine different tours and packages offered by the operator Sumatra EcoTravel Bukit Lawang presented on our website www.sumatra-ecotravel.com. Through the contact on our website or by e-mail you shall ask for the availability of tours and packages at the requested time. You will then receive a noncommittal proposition which you confirm by e-mail, if no changes are necessary. Sumatra EcoTravel will then check availability with the tour operator.

You will then receive a reservation confirmation by e-mail, rendered by Sumatra EcoTravel Bukit Lawang, including all tour and travel details, prices and fees. If you declares acceptance of the offer by paying a deposit to secure the booking, then the contract with the tour operator is concluded. Once the deposit has been received, the client will receive a booking confirmation via email from the tour operator.

Sumatra EcoTravel exclusively carries out all necessary online communication prior to the trip, including making advance reservations. When you decide to make your booking, then the contract will be with the tour operator Sumatra EcoTravel Bukit Lawang.

2. Payment

2.1. Prices

All prices displayed in the offer include value added tax (VAT).

2.2. Deposit / Tour Price

According to the terms and conditions of the tour operator, a deposit of 20 – 100 % of the tour price is payable after the contract is concluded. Sumatra EcoTravel is not entitled to collect the tour price deposit on behalf and for the account of the tour operator. The deposit to secure the booking must be paid by the person making the booking directly to the tour operator.

The deposit shall be made in Euro or IDR.

Further daytrips and adventure tours can be booked and payed in Sumatra if there is capacity. The daily exchange rate is used for all calculations.

IV. Liability

1. As travel agent, Sumatra EcoTravel is, not liable for any damage, injury, loss, delay, expense, inconvenience or otherwise suffered as a consequence of anything, howsoever caused, in connection with the provision and carrying out of the tour and the rendered contractual travel services. Sumatra EcoTravel is only liable for the accurate passing on of information and and for assisting clients with the organisation of their trip prior to departure.

2. The client is responsible for obtaining all necessary travel documents and visas themselves and for complying with all laws, regulations, orders, requirements and travel regulations of Indonesia. Before departure, the client must prepare all legally required entry, exit, health and other documents. The client is responsible for paying any fines or fees imposed by the relevant authority. The client is responsible for obtaining all necessary information regarding regulations, laws and travel requirements.

V. Information

1. As travel broker Sumatra EcoTravel is obliged to handle the booking process with care and to provide all necessary information in advance.

2. Sumatra EcoTravel is not liable for the accuracy of any information given by third parties especially the tour operator in Sumatra after arrival. Sumatra EcoTravel is only liable for the accurate passing on of information prior to departure.

VI. Agreement

By paying the deposit required in the respective reservation confirmation to secure the booking with Sumatra EcoTravel Bukit Lawang, all clients agree to these terms and conditions, as explained above.

VII.

If any of these terms and conditions do not correspond with laws and regulations of Indonesia or international treaties it shall be replaced by the corresponding regulation of the law concerned.
